www.gaiasriches.com is owned and operated by Gaia’s Riches (“Gaiasriches”, “us” or “we”).

Please carefully read these Terms and Conditions of Sale and Delivery (the ”Terms”) before using www.gaiasriches.com (the ”Website”). All information including the Terms on the Website and all information related to the placing of an order is in English and the agreement is entered into in English. The Terms must be accepted by you before placing an order. They are available, any time, on the Website and a copy may be obtained by contacting Gaiasriches by email to support@gaiasriches.com or ordinary mail.

1 YOUR ACCOUNT

To be eligible to purchase products or take up a subscription on the Website and lawfully enter into and form contracts with us you must be 18 years of age or over and be an individual acting for purposes that are wholly or mainly outside your trade, business, craft or profession.
Please ensure that the details you provide us with are correct and complete and inform us immediately of any changes to the information that you provided when you made your purchase or registered as a subscriber.

Gaiasriches reserves the right to refuse access to the Website, terminate accounts, remove or edit content or cancel orders at our discretion where we have a valid reason to do so. If we cancel an order, it will be without charge to you.

2 ORDER RECEIPT AND OUR CONTRACT

2.1 ORDER PROCEDURE

When you place an order to purchase a product or take up a subscription from the Website, we will send you confirmation of your order, containing the relevant details. You are encouraged to review this confirmation and notify Gaiasriches if the order confirmation in your opinion does not correspond to the order placed. You are encouraged to save and possibly print the order confirmation.

Your order represents an offer to us to purchase a product or a subscription which is accepted by us when we ship the product, or in case of subscriptions the first product, to you and when a confirmation is sent to you confirming that we have shipped the order to you. That acceptance will be complete at the time we send an order confirmation to you. You are seeking to enter into a contract with Gaiasriches when you place an order. Gaiasriches will retain the title in the products until full payment has been made by you and has been received by us.

2.2 SUBSCRIPTIONS

By taking up a subscription, you acknowledge that your subscription has an initial and recurring payment feature and you accept responsibility for all recurring charges prior to cancellation.

By purchasing a subscription, you acknowledge that your subscription will be automatically extended for successive monthly periods, at the original subscription rate unless a change in rate is communicated to you and agreed by you prior to the extension.

We strive to take payment for your subscription on the same date each month (the “Recurring Payment Date”) as notified to you.

To cancel your subscription at any time, you must email us at support@gaiasriches.com and inform us that you wish to cancel your subscription. When doing this, please cite the full name and email address that was used when making your first order. Any cancellations of subscriptions need to be done prior to 10am seven working days (Mon.-Fri.) before the next Recurring Payment Date to prevent the charge for the next month.

We carry out any reimbursement (both for Subscriptions and One-Time Purchases) using the same method of payment that you used for the initial transaction, unless we have expressly agreed otherwise.

If you cancel, any special benefits we may have offered you will cease at the point that you cancel.
The above cancellation rights do not affect your right to cancel under the statutory cooling-off period (see below).

If you wish to pause your subscription, you can do so by sending an email to support@gaiasriches.com prior to 10am seven working days (Mon.-Fri.) before the next Recurring Payment Date to prevent the charge for the next month. When pausing your subscription, please cite the full name and email address that was used when making your first order.

The pause period will be valid for up to 3 months, after which time the subscription will be cancelled automatically, if no email is received to re-activate the subscription.

We reserve the right to revoke your subscription at any time at our discretion, e.g., as a result of a violation of the Terms or our Privacy and Cookie Policy. Subscription is void where prohibited by law or regulation.

3 PRICES AND PAYMENT

3.1 PRICES AND CURRENCY

The current price is the price specified on the Website next to the relevant product or subscription model at the date of the order. All products and subscriptions are invoiced in British Pound (GBP) and all prices, charges and costs are quoted in GBP on the Website, on the order confirmation and on the invoice. All prices quoted are inclusive of VAT. We reserve the right to regulate prices and discontinue any products at any time.

3.2 DELIVERY COSTS

The shipment costs will appear on the order summary confirmed by you on the checkout page, prior to purchase and will also appear on the order confirmation sent by e-mail.

Shipping in the UK is done via Royal Mail (2nd Class) – Signed for and takes approximately three to four working days for delivery.

For International shipping, delivery is made via Royal Mail International – Tracked and Signed service and is priced according to Royal Mail rates depending on your region (currently for parcels of up to 1kg: Europe £12.55, World Zone 1 £17.35 and World Zone 2 £18.15).

3.3 CREDIT/DEBIT CARD PAYMENT

We accept payment with recognised credit and debit cards, cf. the Website. The amount is not charged to the card until the order has been confirmed.

If you have purchased a subscription, your credit or debit card will be charged monthly on the Recurring Payment Date.

Website payments are handled by Stripe. The payment system is based on the SSL standard, which means that any information provided in connection with the payment transaction is protected by way of encryption. Card and account information is transmitted in an encrypted form for the purpose of payment and validation and the information is neither registered nor saved in any other way by us.

3.4 DELAYED PAYMENTS

An amount falls due for payment on the Recurring Payment Date for subscriptions or when the order has been confirmed. The purchase is subject to sufficient credit being available on the credit/debit card used for the purchase.

In case of delayed or failed payment, e.g. because the invoiced amount cannot be withdrawn from the account, or if you illegitimately suspend a payment or demand that the payment be reversed, the purchase and/or your subscription may be cancelled and your card may still be charged.

4 DELIVERIES

4.1 TIME OF DELIVERY

Our standard time of delivery is 3-4 working days for UK, 2-5 working days for Europe and 5-10 working days for the rest of the world. As Gaiasriches cannot guarantee for local delivery circumstances, we cannot state with certainty when the product will be delivered to the requested address.

If the shipment of the ordered products is delayed, Gaiasriches will notify you as soon as possible by an e-mail sent to the e-mail address you have provided.

Unless we have agreed a longer delivery time, delivery will be not more than 30 days after the date the contract between us is entered into.

Notwithstanding the foregoing, we will not be held responsible for any delays outside our control relating to delivery.

5 RIGHT OF CANCELLATION

5.1 14 DAYS’ RIGHT OF CANCELLATION

For both Subscriptions and One-Time Purchases, you have the right to cancel the purchase contract within 14 days without giving any reason.
The cancellation period expires 14 days after the date on which you, or the person identified by you to take possession of the goods (other than the carrier), receive the last goods from that order into your physical possession.

To exercise the right of cancellation, you must inform us of your decision by a clear statement setting out your decision to cancel the contract. You can communicate this decision to us by e-mail to support@gaiasriches.com or using the “contact us” link on the website. We will send you an acknowledgement of receipt of your cancellation via email.

You must: (a) provide this notice to us with the time period mentioned above; and (b) send back the goods at your own cost no later than 14 days from the date you informed us of your intention to cancel the contract. The return address is provided at 5.3 below.

In case of Subscriptions, each subscription is for these purposes considered a single order forming part of a regular delivery of products, so you can only cancel a subscription and receive a refund within fourteen days of receiving your first monthly delivery. You can of course cancel your subscription at any time as described in clause 2.2, but it is only if you do so in accordance with this clause 5.1, that you will be entitled to a refund as described in clause 5.2.

5.2 RETURNS

Once you have in due time exercised your right of cancellation of your purchase as described in clause 5.1, we will refund all payments received from you without undue delay once we receive the returned products. Refunds include standard costs of shipping the products to you. We carry out such reimbursement using the same method of payment that you used for the initial transaction, unless we have expressly agreed otherwise.

We may withhold reimbursement until we have received the goods back or you have supplied valid evidence of having sent back the goods.

You have to bear the direct cost of returning the goods. The products should be returned in mint condition and with any individual packaging and seals intact.

6 COMPLAINTS – ERRORS AND DEFECTS

6.1 IN GENERAL

You are encouraged to review and inspect the products immediately upon receipt, including an inspection as to whether the products may be damaged, and to ensure that the products delivered correspond to the products ordered.

6.2 A COMPLAINTS DEADLINE FOR ALL PRODUCTS

You must make us aware by email to support@gaiasriches.com of any errors or defects in the received products within the statutory minimum period from time of purchase or within a reasonable period. Any complaint must be submitted within 30 days of receipt.

The right of complaint only applies to errors and defects related to the product that were present at the time of delivery and not errors and defects which have occurred due to wrongful use in contravention of the user instructions/maintenance instructions, or in case the product has been damaged after the receipt.

6.3 COMPLAINTS AND RETURNS

Any products having errors or defects, shall be returned at Gaiasriches expense but at your risk, and you are thus always encouraged to pack the products sufficiently in case of return. When returning a product, you must specify the nature of such error or defect and you are encouraged to enclose a copy of the order confirmation and/or the invoice.

Products must be returned to the address specified in section 5.3. Any complaints must also be sent to this address.

6.4 REPAIRS AND REPLACEMENT DELIVERIES

In case of an error or a defect related to the product that appears within the deadline specified in section 6.2, and provided that a complaint is submitted in due time, you generally have the right to require Gaiasriches to:
1. Deliver a new product in accordance with the agreement (make a replacement delivery);
2. Accept a proportionate reduction of the purchase price, or
3. Cancel the purchase, if the defect is not insignificant.
A request for replacement delivery cannot be submitted if this is impossible or will result in unreasonable costs for Gaiasriches.

If Gaiasriches accepts making a replacement delivery, you cannot claim a reduction of the purchase price or cancel the purchase.

Gaiasriches must comply with the request within reasonable time. If Gaiasriches does not comply with your request within a reasonable time, you are entitled to claim a proportionate reduction of the purchase price, to cancel the purchase or to request a replacement delivery.

If it is not possible to provide a replacement delivery, Gaiasriches will instead refund the purchase price including any documented shipping expense within the limits of the prices we have defined for our own shipping.

6.5 LIABILITY

As a consumer, you have certain legal rights. These include that any goods will be of satisfactory quality and fit for their intended purpose, (the remedies for defective goods is set out in clause 6.4) that the information which Gaiasriches gives you about the goods and about the terms of this Agreement is to be treated as a term of the contract, and the cancellation rights set out in clause 5. Nothing in the Terms is intended to affect these legal rights.

Nothing in these Terms is intended to exclude or limit the liability of Gaiasriches for death or personal injury due to Gaiasriches’s negligence or that of Gaiasriches’s employees or agents, or for fraudulent misrepresentation by Gaiasriches or its employees or agents.

Gaiasriches does not accept any liability which goes beyond your statutory rights. Gaiasriches cannot in any circumstances be held liable for indirect loss, including but not limited to loss of data or consequential damages.

All information on the Website is for general information purposes and we make no express or implied representations or warranties in relation to the completeness, accuracy, reliability, suitability or availability with respect to the Website or the information, products, services, or related graphics contained on the Website for any purpose. Any reliance you place on such information is therefore strictly at your own risk.

7 COPYRIGHT, LEGAL STATEMENT AND DATABASE RIGHTS

All content and compilation of such content on the Website, such as text, graphics, logos, buttons, images and software is the property of Gaiasriches or its content suppliers.

All software used on this website is the property of Gaiasriches or its software suppliers and is protected by European and international copyright laws. You may not extract and/or re-utilise parts of the contents of the Website without Gaiasriches’ prior written consent. In particular, you may not utilise any data mining, robots, or similar data gathering and extraction tools to extract (either once or many times) for re-utilisation of any substantial parts of the Website. You also may not create and/or publish your own database that features substantial (e.g. our prices and product listings) parts of the Website.

8 ALTERATION OF SERVICE OR AMENDMENTS TO THE TERMS AND CONDITIONS

We reserve the right to make changes to the Website, policies and the Terms at any time. Your usage of the Website and your orders will be subject to the policies and Terms in force at the time that you use the Website or that you order products from us, unless any change to those policies or the Terms is required to be made by law, regulation or government authority (in which case it will apply to orders previously placed by you). For the avoidance of doubt, we will not change the Terms to your detriment in relation to orders which have already been placed. If any of the Terms is deemed invalid, void or for any reason unenforceable, that term or condition will be deemed severable and will not affect the validity and enforceability of the remaining terms and conditions.

9 EVENTS BEYOND OUR REASONABLE CONTROL

Gaiasriches will not be held responsible for any delay or failure to comply with our obligations under the Terms if the delay or failure arises from any cause which is beyond our reasonable control. This provision does not affect your statutory rights.

10 GOVERNING LAW AND JURISDICTION

If you live in England or Wales your use of the Website and any purchase will be deemed to have occurred in England and Wales, and shall be governed by the laws of England and Wales and any disputes shall be subject to the non-exclusive jurisdiction of the courts of England and Wales. Your statutory rights to bring legal action in the courts of the country where you live are not affected by this condition.
